WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

The Axe Pit LLC

1. In consideration for receiving permission to participate in weapon throwing activities at The Axe Pit LLC, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE The Axe Pit, their officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on or upon the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

2. I agree to obey all safety instructions and act in a safe and prudent manner. I understand that it is my sole responsibility to use good judgment in preventing loss, property damage, and personal injury to myself and others, including that of my accompanying family members. IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.

3. The Axe Pit (“Venue”) or any party designated by The Axe Pit may photograph or film me while I attend the premises of The Axe Pit and use of any and all such photos, video footage and/or video streaming for promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet.

Electronic Signature Authorization

By applying my electronic signature to this agreement, I agree that my electronic signature is the legally binding equivalent of my handwritten signature on paper. I will not, at any future time, claim that my electronic signature is not legally binding or enforceable. By electronically signing and submitting this agreement, I

  1. acknowledge that I have read and fully understand the terms of the agreement;

  2. voluntarily agree to be bound by this agreement; and

  3. certify that I am 18 years of age or older. My signature applies to all pages of this contract.

  4. certify that I am the legal guardian of any minors claimed herein.
